Britain’s first transgender judge files lawsuit with ECHR

Former judge of the Supreme Court of England and Wales Victoria McCloud, the first transgender judge in the country’s history, appealed to the European Court of Human Rights (ECHR) on Monday.

McCloud is challenging a ruling by the UK Supreme Court, which in April ruled that the 2010 Equality Act does not include transgender people, even with a gender recognition certificate.

McCloud argues that the court violated her right to a fair trial by not allowing representatives of the transgender community to participate in the case and only considering gender-critical organisations.

Her claim is based on Articles 6, 8 and 14 of the European Convention on Human Rights, which guarantee the right to a fair trial, respect for private life and non-discrimination.

The Supreme Court’s decision has far-reaching implications for the policies of schools, prisons and service providers.

The Equality and Human Rights Commission will soon present an updated code that will define how the law is to be applied. Among other things, it will cover toilets and changing rooms in schools and prisons.

Also in April, the Hungarian parliament passed an amendment to the country’s constitution recognising only two genders — male and female. The decision was supported by 140 MPs, with 21 against and no abstentions. The new version of the constitution states that the family is based on marriage between a man and a woman.

Earlier, US President Donald Trump issued an executive order recognising only two genders in the country — male and female.
